Terms of Service

These Terms of Service (the "Terms") govern your access to and use of Vigil's code-virtualization service, websites, and APIs (collectively, the "Service"). By creating an account or using the Service, you agree to be bound by these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization.

Vigil transforms binaries you supply by applying code virtualization and related hardening techniques, returning a protected artifact. The Service is provided on a subscription basis with monthly usage quotas described on your plan.

You must register using a supported identity provider and keep your account credentials secure. You are responsible for all activity that occurs under your account.

You must be at least the age of majority in your jurisdiction and not be barred from receiving the Service under applicable law, including export and sanctions regulations.

You agree not to use the Service to:

• protect malware, or any code intended to harm systems, evade security controls, or violate the rights of others;
• submit binaries you do not own or are not authorized to process;
• reverse engineer, resell, or circumvent the Service or its usage limits;
• interfere with the integrity or performance of the Service.

You retain all rights to the binaries, debug symbols, and configuration you submit ("Your Content"). You grant Vigil a limited license to process Your Content solely to provide the Service. Vigil does not claim ownership of Your Content and does not use it to train models or for any purpose beyond delivering the protection you request.

The Service, including its software, transformations, and documentation, is owned by Vigil and protected by intellectual-property laws. These Terms grant you no rights to Vigil's marks or technology except the right to use the Service as permitted here.

Paid plans renew automatically each billing period unless cancelled. Usage beyond your plan's quota may be blocked or billed according to your plan. Fees are non-refundable except where required by law.

We strive to keep the Service available but do not guarantee uninterrupted operation. We may modify, suspend, or discontinue features with reasonable notice where practical.

The Service is provided "as is" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Vigil does not warrant that protected binaries are immune to analysis or tampering.

To the maximum extent permitted by law, Vigil will not be liable for any indirect, incidental, or consequential damages, or for any loss of data, revenue, or profits. Vigil's total liability for any claim arising out of the Service will not exceed the amount you paid for the Service in the twelve months preceding the claim.

You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms or use the Service in a way that risks harm to others. Provisions that by their nature should survive termination will survive.

We may update these Terms from time to time. Material changes will be communicated through the Service or by email. Continued use after changes take effect constitutes acceptance of the revised Terms.
